WE ARE INTRODUCING A LEGAL FRAMEWORK TO PROTECT PERSONAL AND CONFIDENTIAL INFORMATION

First off all, lets start off by defining what the GDPR is; GENERAL DATA PROTECTION REGULATION. This is a regulation in EU law on data protection and privacy for all individuals within the European Union. It also addresses the export of personal data outside the EU.

And the definition? The GDPR is a legal framework that sets guidelines for the collection and processing of personal information of individuals within the EU. However, this will soon be implemented in South Africa and will be made a strict law in SA.

WHAT IS CONSIDERED PERSONAL DATA?

“Personal data”  shall mean any information relating to an identified or identifiable natural person (‘Data Subject’); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity.

HOW WILL WE BE PROTECTING YOUR DATA?

 

We as an organization will have certain rules and regulations in order to protect our clients personal data at any and all costs. The GDPR will likely impact smaller companies as a recent study shows that 82% of SME`s are unaware of the new legislation and will potentially be hit with large fines when it starts being enforced next year.

Personal data shall be adequate, relevant and limited to what is necessary in relation to the purpose for which they are processed. Data needs to be accurate and, where necessary, kept up to date. They should be erased or rectified without delay. Data shall be kept in a form that permits the individual identification for no longer that is necessary for the purpose it has been collected. A controller will be responsible for, and must be able to demonstrate compliance with the Data Protection Principles. Personal data will be processed in a way that ensures appropriate security of those data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.
